Under the Residential Tenancies
Act, lessors have various
obligations to their tenants. One
obligation; is that the premises
must be made as secure as
possible against entry by
unauthorised persons. Therefore
the property should have properly
functioning door and window
locks, reasonably solid doors and
adequate lighting.
If home security is not at a
reasonable standard the lessor
may be held legally liable in the
event of theft, damage or injury to
the tenant.
The Act does not determine what
is reasonable security, however in
a court of law, the location and
features of a property would be
taken into account as well as the
circumstances of the situation.
Past case: A tenant contacted a
real estate office to request full
security screens to the ground
floor unit. Quotes were arranged
and presented to the lessor. The
lessor chose not to proceed.
Three days later the tenant
contacted the office to state the
property had been broken into and
that a great $$ value of goods
were taken. The tenant requested
compensation from the lessor for
not providing adequate security.
The lessor refused and the matter
was taken to the Residential Small
Claims Tribunal Court.
Courts decision: The Registrar
ruled against the tenant’s
compensation claim of $5000. It
was considered that the property
was adequately secure, as the
back door had to be kicked in to
gain access.
In this situation, unreasonable
security would have been
considered if there was no forced
entry to the property. i.e. a window
or door with a faulty lock.
In determining reasonable
security, courts may also take into
consideration the requirements for
a tenant to obtain contents
insurance.
This ultimately is resulting in
properties having to have
deadlocks on entry doors and
window locks.
The issue of reasonable security
can sometimes be a grey area,
with varying outcomes if taken to
the Residential Tribunal Courts.
The most important point being
made is to ensure that the
property is safe and secure to
protect your investment.

Be sure to keep your end of month
statements in a safe location (the
folders we hand out are perfect for

keep a copy of tax invoices
relating to your investments.
At the end of the financial year you
will know exactly where to locate
your bills and accounts to pass
onto the Accountant.
Public liability insurance is a must and covers you in the event that there is a slip and fall within the property resulting in personal injury. Do you know if your public liability insurance policy is up to date? Do you have adequate cover? If you have taken out landlord protection insurance, generally you will be covered for public liability. Public liability insurance is also often included in your building insurance. Special Note: If you are the owner of a strata property (i.e. unit or townhouse) your building insurance generally doesn’t cover you for slip and falls within the boundaries of your property. The public liability is generally limited to the common areas. Take the time now to contact your insurance provider/broker to ensure that you have adequate insurance.
